CONTEST RULES


NO PURCHASE NECESSARY AND SPONSOR

These rules govern Fielding Estate Winery’s Winter Wine Weekend Getaway Contest (the "Contest"). No purchase is necessary to enter the Contest. The act of entering the Contest constitutes acceptance of the Contest Rules and Regulations (the “Contest Rules”) and the decisions of Fielding Estate Winery (the "Contest Sponsor") and its agents, which decisions shall be final and binding upon all entrants.

ELIGIBILITY

To enter and to be eligible to win, entrant must be a legal resident of Canada and legal age to drink in Ontario. Employees of the Contest Sponsor, its agents, parent, affiliated or related companies, subsidiaries, divisions, prize sponsors, and promotional and advertising agencies and administrators, and the parents, siblings and children, and persons domiciled with such employees are ineligible to enter the Contest.

HOW TO ENTER

To enter the Contest, visit www.fieldingwines.com between January 15, 2011 and February 15, 2012 (the "Contest Period"), and follow the instructions to enter the Contest. Contest entries are made by answering the optional question “What is your favourite Fielding wine?” and also calculating the answer to the skill testing question required to submit your entry. By doing this you will be randomly entered into a draw to win the contest prize (1 night's accommodation for 2 adults at the Best Western Hotel and Conference Centre and a wine tasting and tour at Fielding Estate Winery with a winemaker's gift package).

THE PRIZES: APPROXIMATE RETAIL VALUE, DISTRIBUTION AND RANDOM DRAW

There is 1 night's accommodation for 2 adults at the Best Western Hotel and Conference Centre and a wine tasting and tour at Fielding Estate Winery with a winemaker's gift package available to be won in the Contest. Accommodations for this Prize Pack are based on hotel availability and must be booked between February 15th, 2012 and April 30, 2012.

Each Prize Pack has an approximate retail value of $500, however the Prize Pack cannot be redeemed for cash. Potential winners shall be selected through a random draw during regular business hours on or after February 15th, 2012 and will be contacted within 4 days of drawing.

ODDS OF WINNING, COLLECTING PRIZES AND RELEASE

The odds of winning a Contest Prize will depend upon the total number of eligible entries and time period received during the Contest Period.

Potential winners will be required to sign a standard declaration and release form ("Release") confirming compliance with the Contest Rules, acceptance of the Contest Prize as awarded and releasing the Contest Sponsor, the Contest Administrator, the prize supplier and any of their respective agents, shareholders, subsidiaries, affiliates, officers or directors from all liability. Potential winners must also correctly answer a time-limited mathematical skill-testing question without mechanical aid and must confirm their eligibility under the Contest Rules.

The Contest Administrator, acting reasonably, will attempt to contact potential winners by email within two (2) business days after the draw. In the event the potential winner fails to provide the Contest Administrator with the completed Release, he or she will be disqualified and an alternate potential winner will be drawn, in which event these provisions shall apply to such other eligible entry. Proof of identification must be provided upon request. 

GENERAL

1. The decisions of the Contest Sponsor, the Contest Administrator and their agents are final, and entrants agree to abide by all of such decisions. In the event of any dispute regarding the interpretation of these Contest Rules or any such decision, such decision shall prevail. Neither the Contest Sponsor, the Contest Administrator, the prize supplier nor their respective agents, shareholders, subsidiaries, affiliates, directors, officers or employees shall be held responsible for any accident, negligence, printing, administrative or other errors that may arise or occur in connection with the Contest. The Contest Sponsor reserves the right to modify, amend or terminate this Contest with no obligation or liability, subject to applicable law.

2. All Contest entries become the sole property of, and are subject to verification by the Contest Sponsor and its agents. Any entry that is illegible, incomplete, altered, or contains false information, will be invalid. No correspondence will be entered into except with the selected potential winning entrants.

3. Any attempt to tamper with the entry process, interfere with these Contest Rules, deliberately damage any website or undermine the administration, security or legitimate operation of the Contest, as determined in the sole discretion of the Contest Sponsor and its agents, (the "Prohibited Acts"), may be a violation of criminal or civil law, and the Contest Sponsor reserves the right to seek damages and/or other relief from all persons responsible for such Prohibited Acts, which may include banning or disqualifying entrants from this and future contests of the Contest Sponsor. 

4. The Contest Sponsor, Contest Administrator and their agents reserve the right, in their sole discretion, to substitute any component of a prize for its cash value or a prize of approximately the same or greater retail value. Prizes are non-transferable (except to a member of the winner’s immediate family with the permission of the Contest Sponsors) must be accepted as awarded and cannot be exchanged for cash or other substitutes. The refusal by any entrant to accept any prize releases forever discharges the Contest Sponsor, the Contest Administrator, the prize supplier and their respective agents, shareholders, subsidiaries, affiliates, directors, officers and employees of all obligations related to any prize.

5. The Contest Sponsor reserves the right, in its sole discretion and without prior notice, to amend, cancel, close, suspend or reinstate this Contest at any time and for any reason whatsoever.

6. By entering the Contest, each entrant agrees to abide by these Contest Rules, which are subject to change without notice to Contest entrants individually, and each entrant releases the Contest Sponsor, the Contest Administrator, the prize supplier and their respective agents, shareholders, subsidiaries, affiliates, directors, officers, employees, representatives and advertising and promotional agencies, from any damage, loss, injury or liability suffered as a result of or arising from the entrant’s participation in Contest or the use or misuse of any Contest Prize. Neither the Contest Sponsor nor the prize supplier make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of any Contest Prize.

7. The Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations.

8. The Contest and the Contest Rules shall be exclusively governed by and construed in accordance with the laws of the province of Ontario. 

9. By entering this Contest, each entrant consents to the collection, use and distribution of his or her personal information (information that identifies an entrant as an individual, such as e-mail address, home telephone number, age and home address) by the Contest Sponsor, the Contest Administrator and their agents for the purposes of administering the Contest. By entering your friends’ name and email addresses, you confirm your consent for us to send out a personalized email on your behalf. Names and email addresses will be used only to forward your message.

10. The Contest Sponsor is committed to protecting the privacy of entrants' personal information. The Contest Sponsor may also maintain a record of your interaction for customer service, marketing and tax receipting purposes, where required. Occasionally, the Contest Sponsor may use entrants’ personal information to contact them with mission-related communications. 

11. In the event of any discrepancy or inconsistency between the terms and conditions of the Contest Rules and disclosures or other statements contained in any Contest related materials, including but not limited to the Contest website, or any advertising, the terms and conditions of the Contest Rules shall prevail.

12. All intellectual property, including but not limited to trade-marks, trade-names, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned by the Contest Sponsor, its agents the prize supplier, or used under license. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
